The introduction of the EU Rule of Law Regulation 2020-2092 threatens to undermine its very foundation: legal certainty. Indeed, it enshrines a principle of discretion for the Commission in defense of the EU's financial accounts, while also making the very definition of "rule of law" itself vague (and therefore subject to arbitrariness).
The new law that is coming to Ireland is the closest thing to the Orwellian 'crimethink' that has been devised in a Western democracy. Under the guise of fighting 'hate', it creates cases that overturn the presumption of innocence and gives the authorities prosecutorial powers to put STASI to shame.
The rule of law issue in Poland would be over and a new era is beginning, in which Poles will be granted access to the 36-billion-euro national Recovery Fund. But where did we start and where did we end up?
L'Unione Europea, non ha una costituzione; esistono solo le costituzioni nazionali e quelle vanno rispettate. L'UE ha politicizzato la questione "Stato di diritto". Bisogna combattere per cambiare l'UE dall'interno - soprattutto su immigrazione, ambiente ed educazione.
E' financo lecito, e in qual misura, per uno Stato democratico e liberale imporre ai cittadini misure restrittive come quelle del lockdown a fini sanitari? Senza imbarcarci in complessi e tecnici discorsi costituzionali, ragioniamo più filosoficamente sulle caratteristiche che rendono la nostra società libera, come generalmente la riteniamo essere.
Merita rileggere l’art. 101 della Costituzione: “La giustizia è amministrata in nome del popolo. I giudici sono soggetti soltanto alla legge”. Esso esprime il principio che la funzione giurisdizionale non deve rispondere ad altri interessi se non a quelli del popolo sovrano
